During this presentation, employment litigation partner, Bob Kilroy of Mirick, O’Connell, DeMallie and Lougee, LLP will bring clarity to the confusion that often exists as a result of overlapping and/or conflicting statutory leave requirements under the Federal Family and Medical Leave Act, the Massachusetts Paid Family and Medical Leave Act, Massachusetts Earned Sick Time Law, leave as a reasonable accommodation under the Americans with Disabilities Act, and leave under employer-provided short or long-term disability policies. In addition to providing an overview of basic concepts and comparing and contrasting the various types of leave and their application in the workplace, Bob will discuss a variety of common, yet difficult, leave scenarios that will prove useful to HR professionals as they attempt to navigate this complex arena of employment law. As a necessary component of this discussion, Bob will delve into a number of specific leave and/or other accommodation scenarios that have arisen as a result of the COVID-19 pandemic, including the advent of numerous requests to continue working remotely.
